This public offer agreement is concluded between the seller, located at CULTONI.COM, and any interested person in accordance with the terms and conditions provided for in this agreement.

This contract is addressed to an unspecified group of persons.

1. GENERAL PROVISIONS

1.1. The Seller sells goods through the online store at CULTONI.COM

1.2. By ordering goods through the online store, the user agrees to the terms of sale of goods posted on the CULTONI.COM website.

1.3. The current terms and conditions of sale of goods, as well as information about goods posted on the website, are a public offer in accordance with Article 633 of the Civil Code of Ukraine.

1.4. The current terms and conditions may be changed by the seller unilaterally without notifying the user/buyer. The new version of the terms and conditions of this agreement shall enter into force from the moment of its publication on the website, unless otherwise provided by the agreement itself.

1.5. The contract comes into force from the moment the seller sends the buyer an electronic confirmation of acceptance of the order when the buyer places an order on the CULTONI.COM website.

1.6. By providing the seller with his/her phone number, the user/buyer consents to the use of the specified means of communication by the seller, as well as by third parties involved in the fulfillment of obligations to the user/buyer. The data is used to distribute promotional campaigns, news about discounts, promotions, as well as other actions of the seller, about the transfer of the order for delivery, as well as other information directly related to the fulfillment of obligations to the buyer within the framework of this public offer. By placing an order, the user/buyer agrees that the seller may entrust the fulfillment of the contract to a third party, while remaining responsible for its fulfillment.

2. SUBJECT OF THE CONTRACT
2.1. The subject of the agreement is the opportunity provided to the user to purchase for personal needs the goods presented in the catalog of the online store at CULTONI.COM

3. PRODUCT AND PURCHASE PROCEDURE

3.1. The Seller ensures the availability of the goods presented on the website.

The photographs accompanying the product are merely illustrations of it and may differ from the actual appearance of the product. The descriptions and characteristics accompanying the product do not claim to be exhaustive and may contain typographical errors. To clarify information about the product, the Buyer may contact customer support.

3.2. In the event that the seller does not have the goods ordered by the buyer, the seller has the right to exclude the specified goods from the order / cancel the order, notifying the buyer by sending a corresponding e-mail or by phone.

3.3. The Buyer bears full responsibility for providing inaccurate information, which made it impossible for the Seller to fulfill its obligations to the Buyer.

3.4. In the event of a fully or partially prepaid order not being available, the buyer is offered a replacement.

3.5. The buyer's order is placed online, through the shopping cart.

3.6. The maximum time for processing and collecting an order is 5 business days.

4. ORDER DELIVERY

4.1. The method and approximate delivery times of goods are indicated on the CULTONI.COM website in the "Delivery and Payment" section.

4.2. Orders are delivered throughout Ukraine. The cost of delivery of each order is calculated independently by the carrier "Nova Poshta", based on the weight of the goods, region and delivery method. The buyer can calculate the delivery independently on the official website of "Nova Poshta" https://novaposhta.ua/

4.3. Orders are dispatched within 5 days of receipt of funds to the account, provided that the goods are in stock. During delivery, the order is handed over to the buyer or a third party specified in the order as the buyer or recipient. If the buyer is unable to receive the order, the order may be handed over to a person who can provide accurate information about the order. When delivering the order, the carrier Nova Poshta has the right to require the presentation of a document certifying the identity of the recipient.

4.4. The parcel is delivered to the warehouse of the carrier "Nova Poshta" specified by the buyer. To receive the parcel, it is necessary to present a passport and declaration number.

4.5. The risk of accidental destruction or accidental damage to the goods passes to the buyer from the moment the order is transferred to the carrier.

5. ORDER PRICE AND PAYMENT

5.1. The price of the goods is indicated in hryvnias and includes all taxes stipulated by law.

5.2. The price of the goods is indicated on the website. In the event of an incorrect indication of the price of the ordered goods, the seller informs the buyer about this to confirm the Order at the adjusted price or cancel the order.

5.3. The price of the goods on the website may be changed unilaterally by the seller. However, the price of the goods ordered by the buyer is not subject to change.

5.4. Payment for the goods is made by the buyer:

5.4.1. In cash upon receipt of the order (in the amount corresponding to the order value specified on the CULTONI.COM website, taking into account discounts, if any) on the terms of payment by cash on delivery through the carrier "Nova Poshta" (payment is made after receipt of the goods at the warehouse of the carrier "Nova Poshta").

5.4.2. By online transfer on the website, in hryvnia, when placing an order (in the amount corresponding to the cost of the order indicated on the CULTONI.COM website, taking into account discounts, if any).

5.5. The Seller has the right to provide discounts on goods and establish a bonus program. Types of discounts, bonuses, the procedure and conditions for their accrual may be changed by the Seller unilaterally.

5.6. The buyer pays the commission of the carrier "Nova Poshta" for the delivery of money from the buyer to the seller additionally.

6. EXCHANGE AND RETURN OF GOODS

6.1 The return of the goods is carried out in accordance with the return conditions specified on the CULTONI.COM website on the “Returns and Exchanges” page.

6.2 The Buyer has the right to refuse the received goods and terminate the purchase and sale agreement in accordance with the Law of Ukraine "On Protection of Consumer Rights" within 14 calendar days.

6.3 The buyer or seller has the right to terminate this contract at any time before the buyer accepts the goods.

6.4 A personally completed return form must be attached to the returned product, stating the reason for the return. Shipping of the goods is at the buyer's expense.

6.5 Return of goods of proper quality:

6.5.1 Return of goods of proper quality is possible within 14 calendar days from the moment of its receipt, provided that the goods have not been used, and their: presentation, consumer properties, attached labels, tags, labels and tags, as well as the presence of factory packaging have been preserved. It is not allowed to apply inscriptions, addresses, etc. to the packaging.

6.6 Return of goods of inadequate quality:

6.6.1 A product of inadequate quality is understood to be a product that cannot fulfill its functional qualities. The difference in design elements, color or design from those stated in the description on the CULTONI.COM website is not a sign of inadequate quality of the product and/or the impossibility of its use for its intended purpose.

6.6.2 After receiving the order, claims regarding external defects of the goods, their quantity, completeness and presentation are not accepted.

6.6.3 If the buyer was given goods of inadequate quality, the buyer has the right, in accordance with the Law of Ukraine "On Protection of Consumer Rights", to demand a refund of the money paid.

6.6.4 The Seller is not responsible for defects in the goods that arose after their transfer to the Buyer as a result of the Buyer's violation of the rules for the use or storage of the goods, actions of third parties, or force majeure circumstances.

6.6.5 If the reason for the return was the seller's error, the buyer will be refunded the full cost of the order. The seller of the online store will also pay for the return shipping of the goods. The error of the seller's / online store employee means: sending a different model; sending a different size; mismatch of the color of the model in the photo. This does not take into account the mismatch of the shade of the same color, due to the fact that the same image may look different on different monitors.

7. DURATION OF THE PUBLIC CONTRACT

7.1. The current public offer comes into force from the moment of its acceptance by the user / buyer and is valid until the moment of withdrawal of acceptance of the public offer.
